1. Introduction
This SMS / Text Messaging Policy ("SMS Policy") explains how The Spa, LLC, d/b/a The Spa by Sheena ("The Spa," "we," "us," or "our") sends text messages, what consent we require, and how you can manage or opt out of those messages. This SMS Policy is incorporated into our Terms and Conditions and Privacy Policy, and supplements (but does not replace) our HIPAA Notice of Privacy Practices with respect to any text message that may contain Protected Health Information.
By providing your mobile phone number and opting in to receive text messages from The Spa, you agree to this SMS Policy.
2. Consent (Opt-In)
We send text messages only to individuals who have given express written consent to receive them. You may provide consent by:

Checking the SMS opt-in box on our patient intake form, online forms, or appointment booking page

Submitting a digital opt-in keyword (e.g., texting JOIN to our designated number)

Signing a written authorization at our location that specifically references SMS communications
Consent is not a condition of receiving any service from The Spa. You may decline SMS communications and still receive treatment.
You represent that the mobile number you provide is yours, that you are authorized to grant consent for that number, and that you will notify us if the number changes or is no longer in your control.
3. Types of Messages You May Receive
If you opt in, you may receive:

Transactional messages — appointment confirmations, reminders, rescheduling notices, gift card and purchase receipts, account alerts, and similar service-related notifications

Promotional messages — offers, sales, new service announcements, event invitations, birthday and loyalty messages

Two-way conversational messages — replies to questions, scheduling assistance, and service follow-ups
Promotional messages require a separate, specific opt-in. If you opt in to transactional messages only, you will not receive promotional messages.
4. Message Frequency
Message frequency varies. Promotional messages are typically sent 1–4 times per month. Transactional messages are sent as needed (appointment reminders, confirmations, receipts).
5. Message and Data Rates
Message and data rates may apply. Text message charges are determined by your wireless carrier and are your responsibility. Check your mobile plan for details.
6. Opting Out (STOP)
You may opt out of SMS messages at any time by replying with any of the following keywords to any message we send:
STOP, UNSUBSCRIBE, CANCEL, END, QUIT
You will receive a single confirmation message acknowledging your opt-out. After that, you will not receive further promotional SMS messages from the platform you opted out from. Note: if you receive both transactional messages (from our scheduling system) and promotional messages (from our marketing platform), you may need to opt out of each separately. Contact us at legal@thespalubbock.com if you wish to opt out of all SMS communications and we will assist.
Opting out of SMS does not opt you out of email or other communications, and does not affect your patient relationship with The Spa.

8. Two-Way Messaging
Some of our SMS communications support two-way conversation. When you reply to a message, your response may be reviewed and answered by our team during business hours. Do not include sensitive medical, financial, or personal information in text messages. SMS is not a secure channel. If you need to communicate sensitive information, contact us by phone or in person.
9. Privacy and Use of Your Information
We use the mobile number and message content only for the purposes described in this SMS Policy, our Privacy Policy, and our HIPAA Notice of Privacy Practices.
We do not sell, rent, or share your mobile number with third parties for those parties' marketing purposes. We share mobile numbers only with our SMS service providers and carriers as necessary to deliver messages.
10. Protected Health Information (HIPAA)
Some text messages we send (such as appointment confirmations) may contain limited information that could be considered Protected Health Information. By opting in to SMS, you acknowledge that:

SMS is not an encrypted or secure communication channel

Messages may be visible to anyone who has access to your mobile device

You accept the risks associated with receiving such messages by SMS
If you do not want to receive any text message that may contain health-related information, opt out using the STOP keyword or contact us to switch to phone or in-person communication only.
11. Eligibility
You must be at least 18 years old and the authorized account holder or user of the mobile number you provide.
12. Carriers; No Liability for Delivery
Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to your carrier's network coverage, your device, and other factors outside our control. Supported carriers include all major U.S. wireless carriers (AT&T, T-Mobile, Verizon, U.S. Cellular, and others).
13. Changes to This SMS Policy
We may update this SMS Policy at any time. The "Effective Date" above will reflect the most recent version. Material changes will be posted on the Website. Continued participation in our SMS program after the Effective Date constitutes acceptance of the updated SMS Policy.
